Acceptable Use Policy

This Acceptable Use Policy ("Policy") applies to anyone who uses Samwise AI Limited's ("Samwise AI", "we", "us", "our") website located at barad.io (the "Site"), and any of our products and services offered under the Barad name, including our online coding harness and the AI-powered coding agents it runs (the "Agents"; together with all the foregoing, the "Services"). This Policy is a Supplemental Term referenced in, and forms part of, our Terms of Service. By using any of our Services, you agree to comply with this Policy.
We aim to ensure our Services are used safely, lawfully, and responsibly. Samwise AI reserves the right to determine, in its sole discretion, whether your use of the Services — including any content you provide, transmit, upload, generate, publish, or otherwise make available ("Content") — violates this Policy.
We may update this Policy from time to time as our Services, technologies, associated risks, laws, and standards evolve. If we make material changes, we will provide notice, which may be through the Services, by email, or by other reasonable means.
Prohibited uses
You must not use the Services:
- in any way that breaches, or facilitates or incites the breach of, any applicable laws;
- in any way that is unlawful, fraudulent, or deceptive, or has any unlawful, fraudulent, or deceptive purpose or effect (including scams, coordinated inauthentic behaviour, fake review generation, disinformation, or spam);
- to create, transmit, or distribute malware, spyware, adware, ransomware, exploits, or any other harmful code, or any code designed to adversely affect the Services, any software or hardware, or any other person's systems or data;
- to scan, probe, identify, or exploit any actual or potential security vulnerability in any third-party website, application, network, or system, without specific prior written authorisation from that third party;
- to conduct, enable, or facilitate denial-of-service attacks, port scanning, credential stuffing, brute-force attacks, or any other attack on any system or network;
- to attempt to escape, weaken, probe, or interfere with the isolation of sessions or execution environments, or to access or attempt to access the sessions, data, or credentials of any other customer;
- to mine cryptocurrency, perform proof-of-work or proof-of-space computation, or otherwise consume session compute for purposes unrelated to software development directed by you;
- to operate services for third parties from sessions, or to use sessions as generic hosting, proxies, relays, or exit nodes;
- to send, initiate, or facilitate unsolicited, bulk, or automated outbound communications;
- to circumvent, disable, or interfere with any security, access-limitation, authentication, rate-limiting, resource-limiting, or invitation feature of the Services, or any bot-detection mechanism, robot exclusion header, or similar technical or legal measure of any third-party website, application, or system (including by obfuscating or misrepresenting an Agent's nature or identity);
- to construct or enrich profiles of other individuals;
- in a way that infringes, misappropriates, or violates any intellectual property or other rights of Samwise AI or any other person, including the terms or licences of any repository, package, or codebase you connect or use;
- to reverse engineer, decompile, unbundle, disassemble, or otherwise attempt to derive the source code of, or create derivative works based on, the Services, except to the limited extent such actions cannot lawfully be prohibited;
- to attack, recreate, access, inspect, or derive any underlying data or models used to train, create, or that are otherwise used by or accessible via the Services (including model architectures, algorithms, weights, parameters, hyperparameters, embeddings, and calibrations), including by prompt injection, model poisoning, model inversion, or model distillation;
- to conduct or facilitate text or data mining, web-scraping, harvesting, or other automated analytical techniques directed at our Services, for any purpose including training, fine-tuning, testing, or validating AI systems or models;
- via any "robot", "bot", "spider", "scraper", or other automated device, program, tool, or process to access, obtain, copy, monitor, or republish any portion of our Services (other than your own use of the Services as designed);
- to reproduce, duplicate, copy, sell, trade, resell, or exploit for any commercial purpose any portion of our Services, including by sharing or reselling access to your account or invitation;
- to make, or as the sole or primary basis for making, any automated decision — without meaningful human review and oversight — that could have a significant effect on any person, including decisions relating to employment, credit, housing, insurance, education, healthcare, or access to essential services; or
- to intentionally, or in a manner that is negligent or reckless as to the possibility that it may, process the personal data of persons under 18; government-issued identification numbers (e.g. Social Security numbers, national insurance numbers, passport or driving licence numbers); health insurance information or other health-related data; genetic, neural, or biological data; data revealing racial or ethnic origin, religious or philosophical beliefs, political opinions, sexuality, sexual orientation, gender identity, citizenship or immigration status, trade union membership, or status as a victim of crime; passwords or financial account credentials (other than credentials you provide to operate the Services as designed); tax return data; payment card data subject to PCI-DSS; data relating to criminal convictions or offences; or any other protected category of personal data under applicable privacy laws.
Content and service standards
You will ensure that all Content you provide to or through the Services, or that you use the Services to generate or publish:
- complies with all applicable laws and does not include, promote, or facilitate unlawful or illegal content or activity;
- is not intended or likely to deceive or mislead any person;
- does not misrepresent your identity or affiliation with any person, impersonate any person, or use any person's likeness without their consent;
- does not give the impression that it emanates from or is endorsed by Samwise AI;
- is not defamatory, obscene, offensive, hateful, or inflammatory;
- does not include or promote sexually explicit material;
- does not bully, harass, embarrass, exploit vulnerabilities in, insult, intimidate, threaten, or humiliate any person;
- does not promote or incite violence, hatred, or discrimination based on race, sex, gender identity, religion, nationality, disability, sexual orientation, or age;
- does not undermine democratic processes;
- does not expose minors to age-inappropriate content or facilitate minors' access to age-restricted goods, services, or activities;
- does not groom, abuse, or exploit minors, and does not include, depict, or promote child sexual abuse material;
- does not encourage, promote, or provide instructions for self-harm, suicide, eating disorders, or dangerous challenges;
- does not facilitate the sale of drugs, weapons, or counterfeit goods, or encourage or induce acts of terrorism;
- does not breach any legal duty owed to any person, including any contractual duty or duty of confidentiality;
- does not abuse or invade any person's privacy; and
- does not infringe any intellectual property right, including copyright, database right, or trade mark, of any person.
Responsible AI use
You are solely responsible for determining whether your use and configuration of the Services — including the instructions you give Agents, the repositories and services you connect, and the level of autonomy you grant — is appropriate for a given task.
You must:
- exercise human judgment and oversight before relying on, or acting on, any AI-generated content or any action taken by an Agent — including reviewing, testing, and validating generated code before you merge, deploy, publish, or otherwise rely on it — and not delegate decisions that may significantly affect you or another person to an Agent;
- ensure that, where an Agent's output or activity is presented to others in a context where its automated nature is material, that nature is appropriately disclosed;
- not remove, alter, or obscure any watermark, metadata, or technical identifier applied to content to identify it as AI-generated; and
- not use the Services in any manner prohibited or considered "high risk" under the EU AI Act or similar regulations governing artificial intelligence systems.
You are responsible for all actions that result, directly or indirectly, from your use of the Services, as if they were your own, and for ensuring those actions comply with this Policy, our Terms of Service, and applicable law.
Violations of this Policy
We may use automated systems and human review to detect violations of this Policy. We may report illegal content to appropriate law enforcement or other authorities, and we may suspend or remove content and/or suspend or terminate account access where we identify potential or actual violations.
You may report content you have accessed through our Services that you believe violates this Policy to us at support@barad.io.
